When a family member passes the process of passing ownership of the property and assets of the deceased to the family members who survive is generally referred to as “Probate”. Most of the time, the process of submitting the Estate to the Probate Court and carrying out the directions in the Will or otherwise transferring the Estate’s property to the family members is an easy, dispute-free process and the Thompson Law Firm is happy to help you if this is the case.
There are many times however that a dispute arises between the surviving family members. Most disputes occur when someone contests the validity of a Will that has been offered to the Court, disputes the marital status of the deceased or a surviving family member, disputes the identity of the biological children of the deceased, or the assets that actually belong to the Estate. These are serious matters and, depending on the size of the Estate, may fundamentally effect how you, your children and their children live the rest of their lives.
